2. Data we process

In particular, we process the following personal data:

  • Order and contract data: name, billing and delivery address, e-mail address, phone number, products ordered, prices, order and delivery status, and details of repair and service orders.

  • Payment data: payment method, payment status and transaction details. We do not receive full card details; these are processed directly by the payment provider.

  • Customer account: if you open a customer account, your login data, saved addresses and order history.

  • Communication data: content and time of your enquiries by e-mail, phone or WhatsApp.

  • Newsletter data: e-mail address, time of subscription and unsubscription, and information on how you use the newsletter (e.g. opens and clicks).

  • Technical and usage data: IP address, date and time of access, pages visited, browser, operating system, device type, referring page, and information from cookies and similar technologies.

We receive most data directly from you. You are not obliged to provide us with data. However, we cannot process an order without certain information.

3. Purposes and legal bases

We process personal data for the following purposes:

  • processing orders, deliveries, payments, returns and warranty claims;

  • advice, repair and service work and answering enquiries;

  • managing customer accounts;

  • sending the newsletter and offers, if you have given your consent;

  • operating, securing and improving the website and the online shop;

  • advertising our products, e.g. via Google Ads;

  • complying with legal obligations, in particular accounting and retention obligations;

  • enforcing or defending legal claims.

Where the GDPR applies, we rely on the following legal bases: performance of a contract and pre-contractual measures (Art. 6(1)(b) GDPR), legal obligations (Art. 6(1)(c)), our legitimate interest in running our business securely and efficiently (Art. 6(1)(f)), and your consent (Art. 6(1)(a)), which you can withdraw at any time with effect for the future.

4. Website and online shop (Wix)

Our website and online shop run on the Wix platform (Wix.com Ltd., Namal Tel Aviv St. 40, 6350671 Tel Aviv, Israel). Wix stores and processes the data of the website, the shop, customer accounts, orders and newsletter contacts on our behalf. The data may be stored on servers in Israel, the EU, the USA and other countries.

When you visit the website, Wix automatically collects technical data (server log files) and sets cookies that are necessary for operation, for example for the shopping cart, login and security. We also use Wix to compile visitor statistics in order to improve our offering. For more information, see the Wix privacy policy: www.wix.com/about/privacy.

5. Payment processing

Payments in the online shop are processed via Wix Payments. Depending on the payment method chosen, Wix Payments, the payment service providers involved and, where applicable, Apple (Apple Pay) or Google (Google Pay) process your payment data, also for fraud prevention. We only receive the information needed for processing, e.g. payment status, payment method and the last digits of the card. If you choose another payment method offered at checkout (e.g. Klarna), that provider’s privacy policy also applies.

6. Shipping

For delivery, we pass on your name, delivery address and, where applicable, e-mail address or phone number to Swiss Post (Die Schweizerische Post AG) or the transport company commissioned, so that the parcel can be delivered and you can be informed about the delivery status.

7. Newsletter

If you subscribe to our newsletter, we use your e-mail address to send you news, promotions and offers as well as your welcome discount. The newsletter is sent via Wix e-mail marketing. Statistics are compiled on whether and when an e-mail is opened and which links are clicked. You can unsubscribe at any time via the link in every e-mail or by writing to info@dalucashop.ch.

8. Contact by e-mail, phone and WhatsApp

When you contact us, we process your information in order to answer your enquiry. Order confirmations and other messages about your order are sent by e-mail via Wix.

Our website has a WhatsApp button. WhatsApp only opens when you click on it. Communication via WhatsApp is subject to the privacy policy of WhatsApp (WhatsApp Ireland Limited, part of Meta Platforms); data may also be transferred to the USA. Please do not send us sensitive personal data via WhatsApp. You can also reach us at any time by e-mail or phone.

9. Google Maps and social media

We embed a Google Maps map on the home page and the contact page (Google Ireland Limited or Google LLC, USA). When the map loads, your IP address and technical data are transmitted to Google. More information: policies.google.com/privacy.

We only link to Instagram, Facebook and TikTok. Data is only transmitted to these platforms when you click a link; their privacy policies then apply.

10. Google Ads and Google Search Console

We advertise our products via Google Ads and may use Google conversion tracking for this purpose: if you reach our website via a Google ad, Google sets a cookie that allows us to see whether an ad led to a purchase or another action. We only receive statistical reports that do not allow us to identify you directly. We use Google Search Console to check how our website appears in Google Search. The provider is Google Ireland Limited or Google LLC (USA). You can deactivate personalised advertising at adssettings.google.com.

11. Cookies

Cookies are small files that are stored on your device when you visit a website. We use necessary cookies (e.g. for the shopping cart, checkout, login and security) as well as cookies for statistics and advertising (see sections 4 and 10). Your confirmation of the age check for liqueurs and spirits is only stored locally in your browser. You can delete or block cookies in your browser at any time; however, without necessary cookies the online shop will not work fully.

12. Disclosure to third parties and abroad

We do not sell your data. We only disclose personal data where necessary for the purposes described: to our service providers (in particular Wix, payment and shipping providers and Google), to authorities where we are legally obliged to do so, and to advisers such as our accountants, where necessary.

Some recipients are located outside Switzerland, namely in the EU, Israel and the USA. We only transfer data to countries without an adequate level of data protection with appropriate safeguards, for example based on the recipient’s certification under the Swiss-U.S. Data Privacy Framework or on standard contractual clauses, or where a statutory exception applies, for example because the transfer is necessary to perform a contract with you.

13. Retention

We process and store personal data for as long as necessary for the respective purposes or as required by law. We keep business records such as orders and invoices for ten years (Art. 958f Swiss Code of Obligations). We store newsletter data until you unsubscribe. We delete your customer account on request, unless we are obliged to retain the data.

14. Data security

We take appropriate technical and organisational measures to protect your data against loss and unauthorised access. Data transmission on our website is SSL/TLS encrypted. However, absolute security cannot be guaranteed for transmission over the internet.

15. Your rights

Within the framework of applicable data protection law, you have the right to information about your personal data, to the correction of inaccurate data, to erasure, to restriction of processing, and to receive or transfer your data. You may object to processing and withdraw your consent at any time. These rights may be restricted, for example if we are legally obliged to retain data. An e-mail to info@dalucashop.ch is sufficient for your request; we may ask for proof of identity.

You also have the right to lodge a complaint with the competent supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC, www.edoeb.admin.ch); in Liechtenstein, the Data Protection Authority (www.datenschutzstelle.li).

16. Automated decisions

We do not make decisions based solely on automated processing that have legal effects on you or significantly affect you.

17. Changes

We may amend this privacy policy at any time. The version published on this website applies.
